Contractualisation
Basic rules
Contractualisation implies the signing of two successive convention types :
1. First, a frame convention :
- This convention is signed on the intermunicipal level, i.e. between an intermunicipal structure and the EPF
- It frames and defines the particulars of the partnership between the EPF and the intermunicipal structure and lists all of the operations to be carried out by the EPF on the intermunicipal territory. It offers an overview of the proposed land action.
- It describes notably :
- The EPF's intervention lines
- The development project on the intermunicipal territory
- The duration of the EPF's intervention
- The list of operations validated by the intermunicipal structure
- The budget for these interventions
2. Second, an operational convention :
- This convention is signed on the municipal level, i.e. between a commune and the EPF
- It relates to a single operation. Thus, a commune may sign several operational conventions (one per operation).
- It defines the particulars of the EPF’s intervention: Details of the purchase, management and sales of the properties required to carry out the development project.
- It describes notably :
- The community's development project justifying the EPF's intervention. If the commune has not yet defined a project, it will commit to start defining one in the two years that follow the signing of the convention
- Details of the land and assets purchases by the EPF
- Management of owned assets
- If required, works to be carried out (programme, financial details)
- The duration of the EPF's intervention
- The method used to set the price upon the resale of the asset (the EPF purchases assets to manage and if needed redevelop them, then sells them once its work is complete).
